These Terms of Service ("Terms") govern your access to and use of the services offered under the Ecom Polygon brand. Ecom Polygon is operated by YERISEL SARL AU, a company incorporated under the laws of the Kingdom of Morocco. In these Terms, "Ecom Polygon," "we," "our," and "us" refer to YERISEL SARL AU.

By accessing or using our website, platform, certification services, or any related services (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. ABOUT ECOM POLYGON

We operate an e-commerce certification standard under the Ecom Polygon name. We evaluate e-commerce brands against a structured framework known as the Ecom Polygon Standard (EPS). Our Services include certification assessments, scoring, certificate issuance, and related digital tools.

Ecom Polygon is an independent certification body. We do not provide agency services, consulting, or implementation work. We evaluate and certify.

2. ELIGIBILITY

You must be at least 18 years old and have the legal authority to enter into these Terms. By using our Services, you represent that you meet these requirements. If you are using the Services on behalf of a business, you represent that you have the authority to bind that business to these Terms.

3. ACCOUNT REGISTRATION

To access our certification platform, you must submit an application and be approved by Ecom Polygon. Upon approval, you will receive credentials to access the Ecom Polygon portal.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. CERTIFICATION SERVICES

4.1 Assessment Process Our certification process evaluates your e-commerce operations against the Ecom Polygon Standard across six stages (EPS-01 through EPS-06). Each stage is assessed through a structured questionnaire and reviewed by our evaluation team.

4.2 Free and Paid Stages EPS-01 (Positioning and Brand) and EPS-02 (Store Architecture) are available at no cost. EPS-03 through EPS-06 require payment to access. Pricing is displayed on our platform and may be updated from time to time.

4.3 Scoring and Certification Each stage is scored on a scale of 0 to 100. A minimum score of 70 out of 100 is required to achieve certification for each stage. Scoring is determined by our evaluation team based on the information you provide and our review of your operations.

4.4 Certificates Upon achieving a passing score, you will receive a digital certificate with a unique identifier. Certificates are issued to the organization, not to individuals. Certificates are valid for 12 months from the date of issuance and must be renewed through re-assessment.

4.5 No Guarantee Certification is not guaranteed. We reserve the right to deny certification to any applicant based on our evaluation criteria. Our assessment reflects a point-in-time evaluation and does not constitute an endorsement or guarantee of future performance.

5. PAYMENTS

5.1 Fees Fees for paid certification stages are displayed on the platform. The currency and amount applicable to your purchase are shown at checkout or on the order page unless otherwise stated. Fees are non-refundable except as required by applicable law.

5.2 Payment Processing Payments are processed through third-party payment processors. We do not store your payment card information. By making a payment, you agree to the terms of the applicable payment processor.

6. INTELLECTUAL PROPERTY

6.1 Our Property The Ecom Polygon name, logo, certification badges, the EPS framework, assessment questions, scoring methodology, and all related materials are the intellectual property of YERISEL SARL AU. You may not reproduce, modify, distribute, or create derivative works without our written permission.

6.2 Certification Badge Usage Certified organizations may display the Ecom Polygon certification badge on their website, marketing materials, and business communications, subject to our badge usage guidelines. The right to display the badge is conditional on maintaining a valid, unexpired certification. Misuse of the badge may result in revocation of certification.

6.3 Your Content You retain ownership of all data and content you submit through the platform. By submitting content, you grant Ecom Polygon a non-exclusive, worldwide license to use such content for the purpose of providing our Services, including evaluation and certification.

7. CERTIFIED BRANDS DIRECTORY

Certified organizations may be listed on our public Certified Brands directory. Listing is subject to approval by Ecom Polygon. We reserve the right to add or remove organizations from the directory at our discretion.

8. PRIVACY

Your use of our Services is subject to our Privacy Policy, which is incorporated into these Terms by reference.

9. DISCLAIMER OF WARRANTIES

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT CERTIFICATION WILL RESULT IN INCREASED REVENUE, IMPROVED PERFORMANCE, OR ANY SPECIFIC BUSINESS OUTCOME.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YERISEL SARL AU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. INDEMNIFICATION

You agree to indemnify and hold harmless YERISEL SARL AU, its directors, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

12. TERMINATION

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination shall survive.

13. MODIFICATIONS

We may update these Terms from time to time. The updated Terms will be posted on our website with a new "Last Updated" date. Your continued use of the Services after any changes constitutes acceptance of the updated Terms.

14. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Morocco. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Morocco.

15. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and YERISEL SARL AU regarding the Services and supersede all prior agreements.
